We are able to provide advice on the process of applying to become a Financial Deputy for a family member. This is an option when that family member has not already made a Power of Attorney to deal with their property and financial affairs and no longer has the capacity to grant a Power of Attorney.
We will go through the process, advise about costs and explain the factors the Court of Protection considers when looking at who should be appointed as a Deputy including who the Court might consider a suitable Deputy. We will confirm who will need to be notified or served with any details of the application to the Court of Protection. We can prepare the application documents, submit them to the Court and liaise with the Court throughout the application.
Deputies will be given details of their obligations and duties so that they are aware of what is expected of them.
We can also advise on and prepare applications to the Court of Protection for Attorneys and Deputies on a range of issues, including:
- Gifting
- Renting out the protected party’s home to a family member.
- Repairs or renovations to the protected party’s house.
- Applications to sell or purchase a property for the protected party.

It is important that advice is sought and, if appropriate, an Order from the Court of Protection is obtained, before Attorneys or Deputies undertake significant decisions as failure to do so could lead to them being sanctioned, required to pay funds back or removed as an Attorney or Deputy.
